ACC & POA
A community-driven proposal to align the architectural review process and covenant administration under the Bella Vista Property Owners Association, giving members a greater voice in the stewardship of their community.
Frequently Asked Questions
Has this agreement been decided?
Yes. The POA Board has reviewed the proposal at its June 18 work session, where no vote was taken. A formal vote happened at the regular meeting on June 25 at 6 pm.
Can the City manage the ACC?
The relevant Arkansas law, Code 14-56-204ย – A municipality shall not regulate residential building design elements. This means exterior color, type of style…ect.
What is being proposed?
That the authority to review building and exterior plans, to administer that review, and to enforce Bella Vistaโs Protective Covenants move to the POA. Today this review is handled by an Architectural Control Committee operating under the Developer. Under the proposal, the POA would administer it going forward.
If the POA does the reviews, who makes the rules?
The Protective Covenants and design standards remain the responsibility of the Developer. The POA would administer and enforce those standards and may recommend changes.
How can I get involved or serve on the ACC board?
The POA will invite members to apply to serve on the ACC board, similar to other POA committees. Watch the POA newsletter for the application.
Will my assessments or dues go up?
No. Architectural review is funded by the fees collected during the review process, not by member assessments. Both that fee revenue and the ACCโs operating budget would transfer to the POA along with the responsibilities, so the work is supported on its own, and this change does not affect your assessments.
Will this make getting approvals easier for people building or improving a home?
A common frustration we have heard is that building or improving a home in Bella Vista can mean working through separate organizations, which takes time and can be confusing. Bringing architectural review under the POA would mean dealing with one community organization rather than two, while the Cityโs permitting process remains unchanged.
I have an application in progress. What happens to it?
Applications already in process would continue without interruption. If anything about where or how you submit changes during the transition, it will be communicated clearly and in advance.
When would this take effect?
Since it was approved on June 25, the transition would take place August 1st.
Did the POA purchase the Welcome Center in Bella Vista?
No. That is unrelated to the POA and any circulation of this news online is false.
